The Purpose of and Basis for Processing Your Personal Data
The purpose of our processing your personal data is to collect payments on your behalf when your recorded music is played publicly and then disburse that money to you. We do this by concluding payment agreements with radio and television stations, shops, coffee shops, fitness centres and others who play back recorded music publicly in Denmark.
Our processing of your personal data is based on Article 6.1.c of the General Data Protection Regulation and section 11(2), paras (1) and (3), of the Danish Data Protection Act.
Categories of Personal Data
We process general personal data such as names, contact info and date of birth as well as information about which recordings you perform on and/or have released.
How We Obtain Your Personal Data
The way we get information about you depends if you are an artist or a recording company and if you are a direct member or represented by an agent.
In addition to the data you provide us with when you contact us, we may – for example – get information about you when a record company notifies us of a new release which you performed on, or when you notify us of a release which you have released as a producer. We may also get information about you if you have an agent or a manager when they – by proxy – send us your discography or claim your repertoire with us.
We also receive information from clients about which releases they have been playing back publicly in Denmark and about when and where they were played. The clients’ reporting and our registration of your rights and your repertoire form the basis for payment of your remuneration from Gramex.
Recipients in International Organisations
If you are a worldwide member, we will exchange information about replayed repertoire with sister organisations abroad which we have agreements with so that you will also get paid for your playbacks outside Denmark. You can find a list of those organisations at www.gramex.dk.
Gramex is a member of SCAPR which is an international umbrella association for organisations managing rights on behalf of performing artists. We transfer information about Danishreleases and rights holders to SCAPR’s international databases VRDB and IPD, see www.scapr.org.
Recipients in Denmark
We submit personal data about you to the Danish Tax and Customs Administration and Statistics Denmark in accordance with the law.
Storing Your Personal Data
As a rule, we keep your personal data for as long as your copyright exists plus five years in accordance with Gramex’ statutory duty to preserve bookkeeping and accounting records appropriately for five years from the end of the relevant financial year.
Access and Complaints
You have a right to be told which personal data we process about you. You may also, at any time, object to our processing of your data. If the data we process about you are incorrect, you have the right to tell us to rectify or erase them. Contacts us at gramex@gramex.dk.
If you wish to file a complaint over our processing of your personal data, you can contact the Data Protection Agency. You can find their contact details at www.datatilsynet.dk.
